These Terms of Use govern your access to and use of aiva.website, a website operated by AIVA ("we," "us," or "our").

1. Service Description

AIVA is an AI video creation platform. We offer features including text-to-video, image-to-video, script generation, storyboard breakdown, character recognition, image generation, voiceover/subtitle/music synthesis, video editing, and exporting to help users quickly generate video content.

2. Account

To access certain features of the Service, you must register using an email address. You are responsible for maintaining the security of your account and for all activities that occur under your account.

3. Free Trial

Newly registered users receive a limited number of free credits ("Free Trial") to experience certain generation features. The specific amount is displayed on the website. The Free Trial does not require providing credit card information.

4. Paid Subscriptions and Credits

AIVA offers pay-as-you-go (Credits) and subscription plans ("Pro Plan").

• Credits: You may purchase credit packages, which are consumed on a per-use basis for generation services. Consumed credits are non-refundable, and credit balances are not redeemable for cash.
• Subscriptions: Subscriptions automatically renew monthly. You may cancel at any time; cancellation will stop further charges after the current period ends.

Payments are processed by our merchant of record, Creem. By subscribing, you agree to Creem's terms of service in addition to these Terms.

• Automatic Renewal: Your subscription will automatically renew each month at the then-current rate. We will charge you at the beginning of each renewal period.
• Cancellation: You may cancel your subscription at any time through your account settings or the Creem customer portal. Upon cancellation, you will retain access to the Service until the end of your current billing period.
• Refunds: Credit packages and subscription fees are generally non-refundable. If you believe you are entitled to a refund, please contact us at contact@aiva.website, and we will review your request on a case-by-case basis. We aim to respond to all refund requests within 3 business days.
• Price Adjustments: We reserve the right to change credit prices or subscription fees. Any price adjustment will take effect at your next billing cycle or subsequent purchase, following reasonable notice.

5. Content and Intellectual Property

You retain all legal rights to the text, images, audio, video, and other materials ("Input Content") you upload to the platform and warrant that you have obtained all necessary authorizations.

Content generated through the Service ("Generated Content") belongs to you, provided you comply with this Agreement. AIVA makes no additional claim to copyright ownership of the Generated Content. However, you agree not to use the Generated Content to infringe upon the legal rights of any third party.

The intellectual property rights of the AIVA platform itself (including, but not limited to, software, algorithms, interface, and brand logo) are owned by AIVA or its licensors. You may not copy, modify, reverse engineer, or use the platform for competitive purposes without our prior written permission.

6. AI-Generated Content Disclaimer

Our videos, scripts, images, and other content are generated by artificial intelligence. While we continuously strive to improve, AI-generated content may contain errors, omissions, or inaccuracies. The Generated Content is for informational purposes only and does not constitute professional advice. You should verify information from original sources before relying on it for important matters. You assume sole responsibility for your use of the Generated Content.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose;
• Scrape, crawl, or use automated tools to access the Service;
• Redistribute, republish, or resell our content or Generated Content;
• Attempt to gain unauthorized access to the Service or its related systems;
• Interfere with the operation or security of the Service;
• Share your account credentials with others, or create multiple accounts to circumvent restrictions;
• Generate or disseminate content that violates applicable laws, infringes upon third-party rights, or is contrary to public order and morals.
